TERMS OF USE
Turn Me Up Games, Inc.
Effective Date: August 2026
Please read these Terms of Use carefully. They form a binding agreement between you and Turn Me Up Games, Inc. Section 14 limits our liability, Section 7 governs unsolicited ideas and submissions, and Section 16 sets the governing law and venue for any dispute.
1 / ACCEPTANCE OF THESE TERMS
These Terms of Use (the "Terms") govern your access to and use of www.turnmeup.la and any pages that link to these Terms (the "Site"). The Site is operated by Turn Me Up Games, Inc. ("Turn Me Up," "we," "us," or "our").
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms apply to the Site only. Our games, products, services, and client engagements are governed by separate agreements, and our recruiting platform is governed by its own terms.
2 / CHANGES TO THESE TERMS
We may revise these Terms at any time. When we do, we will update the Effective Date above. Changes take effect when posted. Your continued use of the Site after we post changes means you accept the revised Terms. If you do not agree to a change, stop using the Site.
3 / WHO MAY USE THE SITE
The Site is intended for a general audience and is not directed to children under 13. By using the Site, you represent that you are at least 13 years old and that you have the legal capacity to agree to these Terms. If you are under the age of majority where you live, you may use the Site only with the involvement of a parent or legal guardian.
The Site is operated from and directed to the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for compliance with local law.
4 / LICENSE TO USE THE SITE
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, informational, and non-commercial use. This license does not include any right to resell, republish, or commercially exploit the Site or its contents, or to use any data mining, scraping, or similar extraction method.
We reserve all rights not expressly granted.
5 / PROHIBITED CONDUCT
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems
- Interfere with, disrupt, or place undue load on the Site or its infrastructure
- Introduce viruses, malware, or other harmful code
- Use bots, scrapers, crawlers, or automated means to access or collect content, except for standard search-engine indexing
- Copy, frame, mirror, reverse engineer, or create derivative works from the Site or its contents
- Remove, obscure, or alter any copyright, trademark, or other proprietary notice
- Harvest contact information from the Site for solicitation, or send unsolicited commercial messages to addresses obtained from the Site
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Use the Site to transmit content that is unlawful, defamatory, harassing, abusive, or infringing
6 / INTELLECTUAL PROPERTY
Our Content and Marks
The Site and its contents — including text, graphics, layout, design, logos, and the selection and arrangement of materials — are owned by Turn Me Up or its licensors and are protected by copyright, trademark, and other intellectual property laws.
TurnMeUp, Turn Me Up, Turn Me Up Games, and the Turn Me Up and Turn Me Up Games logos are trademarks or registered trademarks of Turn Me Up Games, Inc. in the United States of America and elsewhere. You may not use our marks without our prior written permission.
Third-Party and Client Content
The Site displays titles, artwork, logos, and other materials relating to projects we have worked on. Those materials are the property of their respective owners — our clients, publishers, and licensors — and are shown for portfolio and identification purposes only. Nothing on the Site grants you any right to use third-party marks or content, and nothing on the Site should be read as an endorsement by, or affiliation with, any third party beyond the work described.
7 / UNSOLICITED SUBMISSIONS AND FEEDBACK
WE DO NOT ACCEPT UNSOLICITED IDEAS, CONCEPTS, PITCHES, DESIGNS, ARTWORK, STORIES, CHARACTERS, OR OTHER CREATIVE MATERIALS. Please do not send them to us through the Site, by email, or by any other means.
We work on a wide range of projects, and our own teams and our clients independently develop material that may resemble ideas submitted to us. To avoid misunderstanding, we have a firm policy of not reviewing unsolicited creative submissions.
If you send us creative material anyway, despite this notice, you agree that: (a) the material is not confidential and no confidential or fiduciary relationship is created; (b) we are under no obligation to review, return, or respond to it; (c) we may use, reproduce, modify, distribute, and otherwise exploit it for any purpose, without restriction, attribution, or compensation to you; and (d) you will not assert any claim against us relating to any similarity between the material and anything we or our clients develop, produce, or release.
This section does not apply to materials submitted under a signed written agreement with us, or to résumés and portfolios submitted through our recruiting process, which are handled as described in Section 9 and in our Privacy Notice.
Feedback
If you send us comments, suggestions, or feedback about the Site or our business, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without obligation to you.
8 / COMMUNICATIONS THROUGH THE SITE
When you contact us through the Site, you are responsible for the accuracy of what you provide. Do not send us confidential information, trade secrets, or anything belonging to a third party that you are not authorized to share. Communications sent through the Site or by email are not encrypted end-to-end and should not be treated as a secure channel.
9 / CAREERS AND JOB APPLICATIONS
Career opportunities may be displayed or linked on the Site. When you select a job opportunity, you may be redirected to BambooHR, our third-party recruiting platform. Applications are submitted through BambooHR rather than through the Site, and your use of that platform is subject to its own terms and to our Applicant Privacy Notice.
Nothing on the Site, and no listing or communication relating to a role, constitutes an offer of employment or a contract of employment.
10 / THIRD-PARTY LINKS, MEDIA, AND SERVICES
The Site is hosted using Wix and uses iPlayerHD to display our sizzle reel. It may also link to or embed other third-party websites, media, or services. We do not control those third parties and are not responsible for their content, products, practices, or availability. Links and embedded media are provided for convenience and do not imply endorsement. Your dealings with any third party are solely between you and that third party.
11 / PRIVACY
Our collection and use of information through the Site is described in our Website Privacy Notice, which is incorporated into these Terms by reference.
12 / COPYRIGHT COMPLAINTS
We respect intellectual property rights. If you believe material on the Site infringes your copyright, send a written notice to our designated agent that includes: your physical or electronic signature; identification of the copyrighted work claimed to be infringed; identification of the material you claim is infringing and its location on the Site; your contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on the owner's behalf.

13 / DISCLAIMERS
THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. Content on the Site is provided for general informational purposes and may not always be current or complete. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
14 / LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, TURN ME UP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.
Our total liability for all claims relating to the Site will not exceed [ONE HUNDRED DOLLARS ($100)]. These limits apply regardless of the theory of liability and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15 / INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Turn Me Up and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses — including reasonable attorneys' fees — arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
16 / GOVERNING LAW AND DISPUTE RESOLUTION
Informal Resolution First
If you have a dispute with us, please contact us at [LEGAL CONTACT EMAIL] before filing a claim. We will try in good faith to resolve it informally within thirty (30) days.
Governing Law and Venue
These Terms and any dispute arising out of them or your use of the Site are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Turn Me Up agree to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California, and waive any objection to those courts on grounds of inconvenient forum.
Time Limit on Claims
Any claim arising out of or relating to the Site or these Terms must be brought within one (1) year after the claim arises, to the extent permitted by law. Otherwise, it is permanently barred.
17 / TERMINATION AND CHANGES TO THE SITE
We may modify, suspend, or discontinue the Site or any part of it at any time, with or without notice. We may also restrict or terminate your access to the Site at any time, for any reason, including for violation of these Terms. Sections that by their nature should survive termination — including Sections 6, 7, 13, 14, 15, and 16 — will survive.
18 / GENERAL
Entire Agreement. These Terms, together with our Website Privacy Notice, are the entire agreement between you and Turn Me Up regarding the Site, and supersede any prior agreements on that subject.
Severability. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the rest of these Terms will remain in effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our written consent. We may assign them freely, including in connection with a merger, acquisition, or sale of assets.
No Third-Party Beneficiaries. These Terms do not create rights in any third party, except as expressly stated.
Headings. Section headings are for convenience only and do not affect interpretation.
